Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The ETA for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through an electronic search provider some searches are still processed managed manually by the council. Also the search wait time can be affected by seasonal demand levels and Local Authority staffing levels.

Do you recommend that both of us get an Environmental investigation on the property that we are buying in Ancoats? Yes we including this in our quote. We would always recommend an environmental check on the property you intend to purchase which is available from a number of suppliers including Landmark. The environmental check results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, would be officially names as contaminated land by the London Borough/council.

Why is a a CON29DW salient if you want to extent or alter the home in Ancoats? One of the crucial details shows the location of any public sewer on the house you are buying. This is significant because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the design more expensive.

General Conveyancing Tips

Remember there are often a few linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs necessary to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ancoats some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain checks to facilitate release of those ISAs including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within 36 months.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £2500 but is can be more in extreme cases. Second, the lease usually contains a agreement for the assignor to pay a fee to the management company based on a % of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.

About Ancoats.

Ancoats is an area of Manchester in North West England, next to the Northern Quarter, the northern part of Manchester city centre.

Historically in Lancashire, Ancoats became a cradle of the Industrial Revolution and has been called “the world’s first industrial suburb”. For many years, from the late 18th century onwards, Ancoats was a thriving industrial district. The area suffered accelerating economic decline from the 1930s and depopulation in the years after the Second World War, particularly during the slum clearances of the 1960s.

Since the 1990s Ancoats’ industrial heritage has been recognised and its proximity to the city centre has led to investment and substantial regeneration. The southern part of the area is branded as New Islington, by UK property developers Urban Splash, while the north retains the Ancoats name, with redevelopment centred on the Daily Express Building.

For the purpose of local government elections the area is part of the Ancoats and Beswick ward of the city of Manchester.
