What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental enquiries in Andoversford? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Why do we need environmental enquiries in Andoversford? Statutory laws have resulted in a clear-up system for polluted property. The basic position is that the polluter should remediate however where that party cannot be found (for example because the work was done some time ago or the company has gone into a winding up the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an leasehold in Andoversford you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your house to take around eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your transaction and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs required to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Andoversford some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Andoversford

Are you on the panel of Coventry Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Andoversford? Is this a problem? No because like all modern solicitors we count on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Andoversford).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional costs can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation often it is approximately £200-300 but is can be more in extreme cases. Second, the lease often contains a provision for the outgoing to pay a charge to the freeholder based on a percentage of the market value which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
