Searches on my Conveyancing Quote

What is included in a local authority search covering Anerley? There are two parts to a local authority search – LLC1 and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new road schemes, railway schemes or planning permissions relating to the house. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I believe that the local Searches in Anerley will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of identifying contaminated land parcels and recording these land on registers – this is a process which will take a number of years to accomplish. Needless to say any land parcels comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

What is a drainage search ? A Drainage & Water Enquiry confirms to a future buyer that the land parcel they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Anerley which are countryside as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Mouzzam was extremely helpful with our sale and purchase. Always quick to answer my frequent emails and kept us up to date with the whole process of buying and selling our home. I couldn’t fault the service that we recieved and wouldn’t hesitate to recommend them for conveyancing. We have now used KER on three separate occasions for a property purchase, sale and lease extension. On all occasions Mouzzam has provided a thorough, professional and prompt service. We would recommend KER. Very professional, prompt and efficient service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays needed to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Anerley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Anerley

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Anerley? Is this a problem? No because like all modern firms we rely on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Anerley).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within 36 months.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two maisonettes.
