Searches on my Conveyancing Quote

What is included in a local authority search covering Anerley? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new major roads, rail schemes or planning history relating to the land. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I heard that the Con29 Search in Anerley will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that councils are now in the process of identifying contaminated land and recording these sites on registers – this is a process which will take a unknown period of time to end. Needless to say any areas included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

Apart from showing that the site in Anerley is connected to the mains water supply and mains drainage what other information does a Drainage & Water Enquiry contain? A drainage search confirms to a potential owner that the site they are interested in does not need a “build over consent” because the previous owner has constructed an addition to the house over a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all bills required to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Anerley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Anerley

Are you on the panel of Leeds Building Society? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Anerley? Is this a issue? No because like all modern practices we depend on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Anerley).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no SDLT. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a buy to let in Anerley? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We are executors of our fathers estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
