Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental investigations in Annesley? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that we obtain an Environmental investigation on the property that we are buying in Annesley? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of suppliers including Homecheck. The environmental check results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the property, based upon the information revealed by the search, might be classified contaminated land by the Local Authority.

Why is a drainage search essential if you want to extent or alter the property in Annesley? One of the essential results shows information of any public sewer close to the house you are interested in. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the foundations cost more.

General Conveyancing Tips

Remember there are often a few related transactions involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a customer makes is not checking the plan properly. It is a good idea to visit the home to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often customers mistakenly think that a piece of land at the side or rear of the home is theirs, only to discover that the legal title to the land parcel doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Annesley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Annesley

Are you on the panel of Bank of Ireland? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Annesley? Is this a problem? No because like all modern law firms we rely on technology to assist us in our office to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Annesley).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 36 months.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the disbursements up front in our on line quote. The costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company broadly it is around £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 maisonettes.

About Annesley.

Annesley is a village and civil parish in the Ashfield district, in Nottinghamshire, England, located between Hucknall and Kirkby-in-Ashfield. According to the 2001 census the parish had a population of 1,096, increasing to 1,162 (including Annesley Woodhouse) at the 2011 Census. Nearby to the west is Annesley Woodhouse. Presumably the Annesley family, now spread worldwide, originally took its name from that of the village.

The privately owned Annesley Hall is a grade two listed building, once owned by the powerful Chaworth-Musters family and has connections to the Byron family of nearby Newstead Abbey. Annesley Old Church was mentioned by Lord Byron and D. H. Lawrence, two literary figures of importance who lived in Nottinghamshire. There is also close by the earthworks of Annesley Castle

The Misk Hills lie to the south of the village. Annesley is part of Nottinghamshire’s Hidden Valleys area. The parish is grouped with the neighbouring parish of Felley (pop 4) to elect a joint parish council. The village primary school is on Forest Road in Annesley Woodhouse. There is a library in Annesley Woodhouse church hall on Skegby Road which is open three days a week. The old church of Annesley was dedicated to All Saints. It was allowed to become derelict in the 1940s. Features of interest included the east window of the south aisle, the 13th century sedilia and the 17th century royal arms in stucco.

The village is situated on the busy A611 for Mansfield near junction 27 of the M1. Nearby to the south is the roundabout with the A608, which is now a thoroughfare to the large Sherwood Park Enterprise Zone.

It was once connected to Nottingham by rail, until Annesley railway station closed in 1953.
