Searches on my Conveyancing Quote

What is included in a local authority search covering Annfield Plain? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that we get an Environmental investigation on the property that we are buying in Annfield Plain? Yes we including this in our quote. We would always recommend an environmental search on the site you intend to purchase which is available from a number of search companies including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, could be officially names as contaminated land by the local council.

Why is a Drainage & Water Enquiry fundamental if you want to extent or alter the site in Annfield Plain? One of the fundamental details shows a plan of of any public sewer nearby the property you are interested in. This is worth knowing because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the design cost more.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Annfield Plain you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Annfield Plain

Are you able to deal with a mortgage with Cynergy Bank in Annfield Plain? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Annfield Plain.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Stamp Office is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 36 months.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation often it is around £300 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 flats.

About Annfield Plain.

Annfield Plain is a village in County Durham, in England. It is situated on a plateau between the towns of Stanley, 4 km (2.5 mi) to the north-east, and Consett, 8 km (5.0 mi) to the west. According to the 2001 census, Annfield Plain has a population of 3,569 . By the time of the 2011 Census Annfield Plain had become a ward of Stanley parish. The ward had a population of 7,774. Along with much of the surrounding area, Annfield Plain’s history lies in coal mining. While the industry collapsed in the 1980s and 90s, its effects are still apparent both in the landscape and in folk memory.

Much of the surrounding landscape is rough moorland, dominated by the nearby Pontop Pike television mast. Not far from semi-rural Derwentside, however, is the Tyneside–Wearside conurbation, with Newcastle 20 km (12 mi) away, and Sunderland a similar distance. The cathedral city of Durham is 16 km (9.9 mi) away and offers quite a contrast to the former pit villages in the area of Annfield Plain.
