Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The ETA for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches through our search provider’s website some searches are still processed managed manually by the council. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

I think that the official local Search in Apperley will show if the land is contaminated. Is that accurate? No. Whilst it is correct that Local Authorities are now in the process of locating polluted areas and recording these land parcels on registers – this is a process which will take a number of years to end. Needless to say any ground comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Enquiries are likely to be incomplete.

Why is a a CON29 DW search fundamental if you want to extent or alter the site in Apperley? One of the significant results shows the location of any public sewer on the site you are interested in. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the works cost more.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

This firm is probably the best I’ve ever dealt with regarding house moves. Mouzzam was very helpful in dealing with queries and very proactive with dealing with requests. It’s good to have a service that contacts you straight away rather than you having to constantly chase for information and answers. Our house move was a very difficult situation brought on by the buyers but he dealt with it in an exemplary and professional manner.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your property to take around eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the date in Apperley you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Apperley

Are you able to oversee a mortgage with Atom Bank in Apperley? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Apperley.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 3 years.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional fees can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is around £300 but is can be more in unusual cases. Second, the lease could contains a clause for the selling to pay a payment to the management company based on a % of the sale price which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.
