Searches on my Conveyancing Quote

What is included in a local authority search covering Appleby Magna? There are two parts to a local authority search – Local Land Charges search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that both of us obtain a Environmental check on the property that we are buying in Appleby Magna? Yes we including this in our quote. We would always recommend an environmental check on the property you intend to purchase which is available from a number of search companies including Landmark. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the area, based upon the information revealed by the search, might be designated contaminated land by the local council.

What is a Drainage & Water Enquiry ? A a CON29DW confirms to a prospective interested party that the land they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Appleby Magna which are farming areas as there may be a a private drainage system.

Top class solicitors, I was dealing with Mouzzam Yamin who handled everything very professionally especially when things were at difficult stages. They thoroughly make sure in protecting your interests and keep business professional. Hassle free process on recent property purchase with regular updates from Mouzzam Yamin, and all done at a reasonable fee.

General Conveyancing Tips

There is often a mortgage loan to apply for and it should be noted that a conveyancing solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. We must have sight of your official written mortgage offer in order that he may (i) be able to check that you are getting the loan you need and be sure that you can comply with any lender’s conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all costs required to uphold the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Appleby Magna some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Appleby Magna

Are you able to deal with a mortgage with NatWest in Appleby Magna? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Appleby Magna? Is this a issue? No because like all modern lawyers we rely on technology to assist us in our practice to ensure that matters are dealt with speedily. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Appleby Magna).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We are administrators of my parents estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.

About Appleby Magna.

Appleby Magna is a village and civil parish in Leicestershire and Derbyshire, England. It includes the small hamlets of Appleby Parva and Little Wigston, and the villages of Norton-Juxta-Twycross, Snarestone and Swepstone. The parish has a total collective population of 1,084 (2011), with Appleby its largest settlement. Historically, Appleby was one of the largest and wealthiest parishes in Leicestershire, which was reflected by its large church. However, the village and its population have remained fairly small.

The village lies on the edge of the ancient boundary between the kingdom of Mercia and the Danelaw. The land itself has been inhabited from the early Neolithic period. The village developed in the pre-Saxon era.

The name Appleby is derived from aeppel (apple) and by(r) (settlement).

The village sits on the outskirts of the National Forest and is bordered by the Gopsall Park Estate.

The Ashby-de-la-Zouch Canal passes within a mile of the village, as do the M42 and A444.
