Searches on my Conveyancing Quote

What is included in a local authority search covering Appleshaw? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am told that the Land Charges Searches in Appleshaw will show if the land is contaminated. Is that accurate? No. Whilst it is correct that Local Authorities are now in the process of locating polluted sites and recording these land parcels on registers – this is a process which will take a unknown period of time to deliver upon. Needless to say any sites comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

Why is a Drainage & Water Enquiry key if you want to extent or alter the land parcel in Appleshaw? One of the main results shows the location of any public sewer close to the site you are purchasing. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the addition more costly.

General Conveyancing Tips

There is often a mortgage offer to organise and it should be noted that a lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. The Firm should have sight of your final written offer of mortgage in order that they may (i) be able to check that you are getting the money you need and ensure that you can comply with any conditions of the mortgage offer imposed in the facility letter.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a customer makes is not checking the plan properly. It is a best to go to the site to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the home is theirs, only to find out that the legal title to the property doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time scale in Appleshaw you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Appleshaw

Are you able to oversee a mortgage with Cambridge Building Society in Appleshaw? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Appleshaw? Is this a issue? No because like all modern lawyers we count on technology to assist us in our work to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Appleshaw).

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain actions to facilitate release of those funds including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within three years.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation often it is around £200 but is can be higher in unusual cases. Second, the lease often contains a clause for the assigning to pay a charge to the management company based on a percentage of the market value which is mainly 1% although other formula may be used. The lease will need to be checked carefully.

About Appleshaw.

Appleshaw is a village in the English county of Hampshire. The name Appleshaw is derived from Old English ‘scarga’ – a shaugh or wood; thus Appleshaw may mean ‘apple wood’. It includes the hamlet of Ragged Appleshaw, the ‘ragged’ possibly being a corruption of ‘roe gate’ – the gate of the Royal Deer Forest of Chute. The northern boundary of the parish is the Wiltshire border.

This small parish lies on the Wiltshire border and includes the hamlets of Redenham and Ragged Appleshaw, including part of Redenham Park. Granted the right to two annual fairs in 1658, Appleshaw became a rival to the great Weyhill sheep fair.

The Salisbury Journal in 1801 reported that 15,000 sheep were sold at Appleshaw – a reduction on the previous year’s total.

W. G. Grace once played cricket here, with his bat made of Wallop willow.

In the middle of the street a clock sticks out from a barn wall, placed there to celebrate Queen Victoria’s jubilee.

Appleshaw has one school, Appleshaw St Peter’s CE Primary School.
