The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Is there a need environmental investigations in Apsley? Statutory laws have resulted in a clean-up scheme for contaminated land. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the present owner (who could be you). General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to get rid of. You can quicken the process if it is your first buy. You may be able to exchange and complete together. However your desire depend on what  others in the chain will agree to.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a customer makes is not checking the plan properly. It is a best to go to the land parcel to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the land doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills needed to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Apsley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain procedures to facilitate release of those funds including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained probate for my parents estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
