Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Ardingly. Usually, you can search most planning applications on the council’s website by postcode or by map search).

Do you recommend that both of us ask for a Environmental enquiry on the property that we are buying in Ardingly? Yes we including this in our quote. We would always recommend an environmental search on the ground you intend to purchase which is available from a number of search companies including Homecheck. The environmental search results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, might be classified contaminated land by the London Borough/council.

Apart from showing that the home in Ardingly is connected to the mains water supply and mains drainage what other results does a a CON29 DW search show? A water authority search illustrates to a potential owner that the home they are purchasing does not need a “build over consent” because the owner has constructed an extension close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

I can honestly say that Mark Sadler is the best property solicitor I have ever experienced and I have dealt with many over the years. I found him on google after 2 days of searching for the answer to a very complicated freehold/leasehold problem. When I called him about our dilemma, Mark knew exactly how to tackle it and he did so with great ease. He dealt with every communication promptly, courteously and efficiently. I could not have asked for more and I am extremely grateful to him for taking on our case. I would not hesitate to recommend him to anyone with a property related legal issue. Thank you again.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a quote what disbursements apply to your transaction and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs necessary to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ardingly some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Ardingly

Are you on the panel of Atom Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Ardingly.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing assignment packs often in a form called LPE1. The charge for this varies from company to company usually it is around £2500 but is can be more in rare cases. Second, the lease may contains a clause for the selling to pay a payment to the management company based on a % of the market value which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
