Searches on my Conveyancing Quote

How long do Local Authority search searches take? The time for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches electronically some searches are still processed processed manually by the local council. Also the search time can be affected by seasonal demand levels and Local Authority staffing levels.

I think that the Land Charges Search in Ardington will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that councils are now in the process of identifying contaminated ground and recording these land on registers – this is a process which will take a decades to complete. Needless to say any property listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

Why is a drainage search useful if you want to extent or alter the property in Ardington? One of the main results shows a map of any public sewer within the land parcel you are buying. This is significant because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the build cost more.

General Conveyancing Tips

There is commonly a mortgage loan to apply for and it should be noted that a conveyancer cannot rely on a informal confirmation by mortgage broker or anyone else. The conveyancing solicitor must have sight of your official written mortgage offer in order that she may (i) verify that you are getting the advance you need and ensure that you can comply with any conditions of the mortgage offer imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays necessary to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ardington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Ardington

Are you able to deal with a mortgage with Newcastle Building Society in Ardington? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Ardington? Is this a problem? No because like all modern firms of lawyers we depend on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ardington).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a buy to let in Ardington? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold what additional payments can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by landlords and managing agents will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from company to company usually it is approximately £300 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 maisonettes.
