Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such customers think they know what a Official Local Authority search will reveal and may know about the Ardsley or surrounding area however most solicitors will still suggest one. One of the main reasons is that the local search LLC1 is the only place to reveal monies due to the local council and this is more commonly the case with properties where the owner has gone into a home.

I am advised that the Land Charges Searches in Ardsley will show if the land is contaminated. Is that accurate? No. Whilst it is correct that Local Authorities are now in the process of identifying contaminated land parcels and recording these land on registers – this is a process which will take a a long time to complete. Needless to say any ground listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

What is a water authority search ? A drainage search confirms to a prospective buyer that the property they are buying is connected to the mains water supply and mains drainage. This is particularly important in parts of Ardsley which are not built up as there may be a a private drainage system.

General Conveyancing Tips

There is invariably a mortgage offer to apply for and it should be noted that a conveyancer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The Solicitor should have sight of your final written mortgage offer in order that he may (i) verify that you are getting the money you need and ensure that you can comply with any conditions of the mortgage offer imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time in Ardsley you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the executor of my fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
