Searches on my Conveyancing Quote

What is included in a local authority search covering Arford? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Why do we need environmental enquiries in Arford? Statutory legislation have resulted in a clean-up scheme for polluted land. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clear-up costs passes to the current owner (who could be you). Even if you are purchasing an leasehold in Arford you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Apart from showing that the home in Arford is connected to the mains water supply and mains drainage what other results does a a CON29 DW search show? A Drainage & Water Enquiry illustrates to a prospective interested party that the site they are purchasing does not need a “build over consent” because the previous owner has constructed an extension within three metres of a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Would highly recommend Mouzzam at KER. Transaction went through very quickly and smoothly. He always responded quickly to any queries I had. I recommend this firm without any doubt. Mouzzam in particular has been extremely helpful throughout the purchase of our home and has been very easy to liaise with. They (Kenneth, Elliot and Rowe) offer a fantastic service and would definately use them again.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time scale in Arford you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Arford

Are you on the panel of Lloyds Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Arford.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing assignment packs often in a form called LPE1. The charge for this varies from company to company often it is around £200-300 but is can be higher in rare cases. Second, the lease often contains a provision for the assignor to pay a charge to the landlord based on a % of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
