Searches on my Conveyancing Quote

What is included in a local authority search covering Arksey? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I am advised that the Con29 Enquiries in Arksey will show if the land is contaminated. Is that right? Not really. Whilst it is correct that councils are now in the process of identifying polluted sites and recording these land parcels on registers – this is a process which will take a a long time to complete. Needless to say any properties entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

Apart from showing that the site in Arksey is connected to the mains water supply and mains drainage what other data does a drainage search include? A Drainage & Water Enquiry illustrates to a new buyer that the land parcel they are acquiring does not need a “build over consent” because the seller has constructed an alteration over a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading trading down and have a lot of items to clear. You can accelerate the process if it is your first buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time period in Arksey you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Arksey

Are you on the panel of Barclays Bank plc? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Arksey? Is this a problem? No because like all modern firms of lawyers we depend on technology to assist us in our firm to ensure that matters are dealt with quickly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Arksey).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold what additional disbursements can we anticipate? We cannot give you all the disbursements up front in our estimate. The costs charged by freeholder and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.

About Arksey.

Arksey is a village in the Metropolitan Borough of Doncaster in South Yorkshire, England. It was the birthplace of the children’s writer Barbara Euphan Todd on 9 January 1890.

The sey in Arksey means island in Old English, which is appropriate as the village is surrounded by marshland.

Arksey is older than the Domesday Book (more facts on that in an external link below).

The parish church of All Saints is Grade I listed, dating back to the 1120s.
