There is more often than not a mortgage offer to arrange and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. The conveyancing lawyer must have sight of your formal written mortgage offer in order that he may (i) ensure that you are getting the amount you need and ensure that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional fees can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from organisation to organisation mainly it is around £2500 but is can be more in unusual cases. Second, the lease often contains a clause for the selling to pay a payment to the freeholder based on a % of the sale price which is often 1% although other formula may be used. The lease will need to be checked carefully.
