Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a house and do not necessarily have to conduct a search. Many such customers think they know what a Local Authority search will reveal and may know about the Arlington or surrounding vicinity however most lawyers will still advise one. One of the main reasons is that the Official Local Authority search is the only place to reveal indebtedness to the borough and this is more commonly the case with probate properties.

Why do we need environmental checks in Arlington? Statutory rules have resulted in a clear-up system for contaminated ground. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Arlington you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Apart from showing that the land in Arlington is connected to the mains water supply and mains drainage what other information does a a CON29DW show? A a CON29DW illustrates to a future owner that the property they are interested in does not need a “build over consent” because the previous owner has constructed an addition to the house adjacent a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all outlays necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Arlington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Arlington

Are you on the panel of First Direct? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Arlington? Is this a concern? No because like all modern solicitors we depend on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Arlington).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be higher in unusual cases. Second, the lease could contains a clause for the assignor to pay a payment to the landlord based on a percentage of the market value which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
