Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not reveal land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Armston. Usually, you can search most planning applications planning pages by postcode or by map search).

Why do we need environmental searches in Armston? Statutory legislation have resulted in a clear-up scheme for polluted land parcels. The basic position is that the polluter should clean up however where that party cannot be found (for example because the work was done some time ago or the company has gone into bankruptcy the liability for remediation costs passes to the present owner (who could be you). Even if you are purchasing an maisonette in Armston you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

Why is a Drainage & Water Enquiry significant if you want to extent or alter the property in Armston? One of the basic replies shows a map of any public sewer nearby the land you are interested in. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the build more expensive.

Used them for conveyancing on my first property purchase and highly recommend. They have a very straightforward online illustration tool and the team behind it were always very friendly and professional. Thanks go to Mouzzam Yamin and his team. I wouldn’t hesitate to use them again. Thank you all for the great service.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time in Armston you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you able to oversee a mortgage with Royal Bank of Scotland in Armston? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Help to Buy ISAs in Armston? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain steps to make sure release of those ISAs including any bonus. If you complete the estimate you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300k. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information often in a pro forma response called LPE1. The charge for this varies from company to company usually it is approximately £200-300 but is can be more in rare cases. Second, the lease usually contains a clause for the selling to pay a charge to the management company based on a % of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
