Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental checks in Arncliffe? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am advised that the Land Charges Searches in Arncliffe will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating contaminated property and recording these land parcels on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any properties listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

What is a a CON29DW ? A water authority search confirms to a prospective owner that the home they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Arncliffe which are countryside as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Helpful and understanding through a very stressful period in our lives Mouzzam was extremely helpful with our whole process. Lots of experience and very helpful throughout the property purchase and sales cycle. We have used K.E.R. for over two decades and very happy with their service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

Remember there are always likely to be a few linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time period in Arncliffe you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Arncliffe

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

We note that you do not have an office in Arncliffe? Is this a problem? No because like all modern firms we rely on technology to assist us in our practice to ensure that matters are dealt with promptly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Arncliffe).

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain steps to facilitate release of those savings including any bonus. If you complete the online quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within 3 years.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a pro forma response called LPE1. The charge for this varies from company to company on average it is around £2500 but is can be higher in extreme cases. Second, the lease usually contains a mechanism for the assignor to pay a fee to the freeholder based on a percentage of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
