Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a property and do not necessarily have to conduct a search. Many such buyers think they know what a local search LLC1 will reveal and may know about the Arpinge or surrounding neighbourhood however most conveyancing lawyers will still counsel for one. One of the main reasons is that the local search LLC1 is the only place to reveal indebtedness to the local council and this is more commonly the case with .

Do you recommend that I get a Environmental investigation on the property that we are buying in Arpinge? Yes we including this in our quote. We would always recommend an environmental search on the ground you intend to purchase which is available from a number of search providers including Argyll Site Solutions. The environmental search results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the land parcel, based upon the information revealed by the search, might be classified contaminated land by the Local Authority.

Why is a a CON29DW key if you want to extent or alter the property in Arpinge? One of the main details shows a plan of of any public sewer on the home you are purchasing. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your property to take around 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills required to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Arpinge some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Arpinge

Are you on the panel of Royal Bank of Scotland? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Arpinge.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Inland Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 3 years.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I have obtained probate for our mother estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.

About Arpinge.

Arpinge is a hamlet between Paddlesworth and Newington (where, at the 2011 Census, the population was included) to the west of Folkestone in Kent, England. It consists of three working farms, three now converted to residential use and a further four houses. The name probably originates from the Old English ‘eorpa’ (dark-skinned (person)) and ‘inge’ (a settlement). There is no church as it falls within the ecclesiastical parish of Newington-next-Hythe. There are no shops and the nearest pub is the ‘Cat and Custard Pot’ in Paddlesworth.
