Searches on my Conveyancing Quote

What is included in a local authority search covering Arram? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am advised that the local authority Searches in Arram will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of locating contaminated ground and recording these sites on registers – this is a process which will take a many years to end. Needless to say any sites listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

Apart from showing that the land parcel in Arram is connected to the mains water supply and mains drainage what other information does a a CON29DW show? A drainage search shows to a prospective owner that the land parcel they are buying does not need a “build over consent” because the vendor has constructed an addition to the house near a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are commonly several linked transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays incurred to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Arram some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Arram

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Arram? Is this a issue? No because like all modern firms we depend on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Arram).

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain checks to ensure release of those monies including any bonus. If you complete the estimate you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in Arram? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We have obtained Letters of Administration for our mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal fees remain the same as quoted for this type of Seller.
