Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your council covering Arreton. Usually, you can search most planning applications on line by postcode or by map search).

Do you recommend that I order a Environmental check on the property that we are buying in Arreton? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of search providers including Argyll Site Solutions. The environmental enquiry results provide details of present and past environmental risks together with a statement from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, is likely to be designated contaminated land by the local council.

Why is a a CON29 DW search crucial if you want to extent or alter the land parcel in Arreton? One of the critical details shows the location of any public sewer adjacent the home you are buying. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the design cost more.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

This is the 5th time that we used Kenneth Elliott and Rowe. We have bought and sold a few houses and it’s time to let everyone know how reliable and efficient Mouzzam is. He responded to all my emails and calls promptly and advised us …More Mouzzam was very prompt with his responses. Very keen eye for detail, every stone was turned and explanations were provided for all queries. Will use again I was pleasantly surprised, thought I’d be constantly chasing like you do most solicitors, but they were good, would use again. Mouzzam was very responsive, efficient and helpful. Would highly recommend. Mouzzam Yamin handled our conveyancing in a professional and efficient manner. Would happily use KER again. Very pleased with the service we received. General Conveyancing Tips

Remember there are often a few linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest sale or purchase.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a home buyer makes is not checking the plan properly. It is a best to go to the land to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the property is theirs, only to find out that the legal title to the property doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time period in Arreton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Arreton

Are you able to conduct a mortgage with Cynergy Bank in Arreton? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Arreton.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from company to company usually it is around £2500 but is can be more in unusual cases. Second, the lease usually contains a clause for the selling to pay a charge to the freeholder based on a % of the market value which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
