Searches on my Conveyancing Quote

What is included in a local authority search covering Arundel? There are two parts to a local authority search – Local Land Charges search and CON29. The second part of the search – CON29 – supplies information relating to public highways, proposals for new roads, rail schemes or planning permissions relating to the land. The search can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Why do we need environmental investigations in Arundel? Statutory laws have resulted in a clean-up system for contaminated land parcels. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into a winding up the liability for remediation costs passes to the current owner (who could be you). Even if you are purchasing an flat in Arundel you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Why is a water authority search useful if you want to extent or alter the site in Arundel? One of the significant results shows a map of any public sewer nearby the site you are acquiring. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the build cost more.

General Conveyancing Tips

There is commonly a mortgage to obtain and it should be noted that a conveyancer cannot rely on a informal confirmation by mortgage broker or anyone else. The Solicitor should have sight of your final written offer of mortgage in order that they may (i) be able to check that you are getting the advance you need and be able to check that you can comply with any special conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs incurred to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Arundel some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

Are you able to oversee a mortgage with Tesco Bank in Arundel? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Arundel.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Arundel? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is around £2500 but is can be higher in extreme cases. Second, the lease may contains a clause for the outgoing to pay a charge to the management company based on a percentage of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Arundel.

Arundel ( or locally /ˈɑːndəl/) is a market town and civil parish in a steep vale of the South Downs, West Sussex, England.

The much-conserved town has a medieval castle and Roman Catholic cathedral. Although smaller in population than most other parishes, Arundel has a museum and comes second behind much larger Chichester in its number of listed buildings in West Sussex. The River Arun runs through the eastern side of the town.

Arundel was one of the boroughs reformed by the Municipal Reform Act 1835. From 1836 to 1889 the town had its own Borough police force with a strength of three. In 1974 it became part of the Arun district, and is now a civil parish with a town council.
