Searches on my Conveyancing Quote

What is included in a local authority search covering Arundel? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to public highways, proposals for new major roads, railway schemes or planning approvals relating to the house. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do you recommend that we order a Environmental investigation on the property that we are buying in Arundel? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of search companies including Landmark. The environmental check results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the land, based upon the information revealed by the search, might be classified contaminated land by the council.

Why is a water authority search salient if you want to extent or alter the home in Arundel? One of the crucial details shows a map of any public sewer on the home you are interested in. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

Remember there are often many related transactions involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the date in Arundel you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Arundel

Are you able to manage a mortgage with Leeds Building Society in Arundel? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Arundel? Is this a issue? No because like all modern lawyers we count on technology to assist us in our office to ensure that matters are dealt with quickly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Arundel).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional costs can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is approximately £2500 but is can be higher in rare cases. Second, the lease usually contains a provision for the assigning to pay a charge to the management company based on a percentage of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Arundel.

Arundel ( or locally /ˈɑːndəl/) is a market town and civil parish in a steep vale of the South Downs, West Sussex, England.

The much-conserved town has a medieval castle and Roman Catholic cathedral. Although smaller in population than most other parishes, Arundel has a museum and comes second behind much larger Chichester in its number of listed buildings in West Sussex. The River Arun runs through the eastern side of the town.

Arundel was one of the boroughs reformed by the Municipal Reform Act 1835. From 1836 to 1889 the town had its own Borough police force with a strength of three. In 1974 it became part of the Arun district, and is now a civil parish with a town council.
