Searches on my Conveyancing Quote

How long do Local Authority search searches take? The wait time for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed handled manually by the council. Also the search ETA can be affected by seasonal demand levels and Local Authority staffing levels.

When we ask for an Environmental check on the property mentioned on the conveyancing quote for the property in Ash what will it reveal? The search provides information of present and past pollution risks together with a statement from an environmental consultant confirming whether or not the land parcel could be classified contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

Apart from showing that the home in Ash is connected to the mains water supply and mains drainage what other data does a Drainage & Water Enquiry include? A Drainage & Water Enquiry verifies to a new buyer that the house they are acquiring does not need a “build over consent” because the seller has constructed an addition to the house close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is more often than not a mortgage loan to obtain and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. The Solicitor should have sight of your formal written mortgage offer in order that he may (i) ensure that you are getting the loan you need and verify that you can comply with any lender’s conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the date in Ash you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ash

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Ash? Is this a concern? No because like all modern practices we depend on technology to assist us in our work to ensure that matters are dealt with speedily. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ash).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Ash? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional costs can we anticipate? We cannot give you all the disbursements up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing assignment packs often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.

About Ash.

Ash or ashes are the solid remnants of fires. Specifically, ash refers to all non-aqueous, non-gaseous residues that remain after something burns. In analytical chemistry, to analyse the mineral and metal content of chemical samples, ash is the non-gaseous, non-liquid residue after complete combustion.

Ashes as the end product of incomplete combustion are mostly mineral, but usually still contain an amount of combustible organic or other oxidizable residues. The best-known type of ash is wood ash, as a product of wood combustion in campfires, fireplaces, etc. The darker the wood ashes, the higher the content of remaining charcoal from incomplete combustion. The ashes are of different types. Some ashes contain natural compounds that make soil fertile. Others have chemical compounds that can be toxic but may break up in soil from chemical changes and microorganism activity.

Like soap, ash is also a disinfecting agent (alkaline). The World Health Organization recommends ash or sand as alternative when soap is not available.
