Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental checks in Ashbocking? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do we need environmental investigations in Ashbocking? Statutory legislation have resulted in a clear-up scheme for polluted areas. The basic position is that the polluter should clear-up however where that party cannot be found (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Ashbocking you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

Why is a a CON29 DW search key if you want to extent or alter the property in Ashbocking? One of the decisive details shows a plan of of any public sewer nearby the property you are purchasing. This is worth knowing because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the addition cost more.

General Conveyancing Tips

There is commonly a mortgage to organise and it should be noted that a conveyancing lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. The conveyancer will need to have sight of your final written offer of mortgage in order that he may (i) be sure that you are getting the advance you need and be able to check that you can comply with any lender’s conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the date in Ashbocking you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional fees can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £2500 but is can be higher in extreme cases. Second, the lease usually contains a provision for the outgoing to pay a fee to the management company based on a percentage of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
