Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a property and do not necessarily have to conduct a search. Many such purchasers think they know what a Local Authority search will reveal and may know about the Ashbury or surrounding locale however most lawyers will still counsel for one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal liabilities to the local council and this is more commonly the case with probate properties.

Why do we need environmental investigations in Ashbury? Statutory rules have resulted in a clear-up system for polluted sites. The basic position is that the polluter should pay however where that party is missing (for example because the work was done some time ago or the company has gone into a winding up the liability for clear-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Ashbury you may find that you are liable for the cost of any clear-up through the service charge provisions of the lease.

Apart from showing that the home in Ashbury is connected to the mains water supply and mains drainage what other results does a drainage search show? A water authority search confirms to a new buyer that the house they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house over a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays incurred to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ashbury some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Ashbury

Are you able to handle a mortgage with Santander in Ashbury? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Ashbury? Is this a concern? No because like all modern solicitors we rely on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashbury).

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the executor of our family estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our fees remain the same as quoted for this type of Seller.
