Although we order all our Official Local Authority searches through an electronic search provider some searches are still processed handled manually by the local council. Also the search time can be affected by seasonal demand levels and council staffing levels.

Do we need environmental searches in Ashbury? Statutory legislation have resulted in a remediation system for contaminated areas. General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading trading down and have a lot of items to get rid of. You can quicken the process if it is a first time buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will consent to.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a client makes is not checking the plan properly. It is a best to visit the house to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to find out that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all bills incurred to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ashbury some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Ashbury

Are you able to handle a mortgage with Leeds Building Society in Ashbury? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in Ashbury? Is this a issue? No because like all modern solicitors we depend on technology to assist us in our practice to ensure that matters are dealt with quickly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashbury).

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a buy to let in Ashbury? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are executors of our family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
