Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not show developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Ashby. Usually, you can search most planning applications on line by postcode or by map search).

I am told that the local authority Searches in Ashby will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that councils are now in the process of identifying contaminated areas and recording these areas on registers – this is a process which will take a many years to end. Needless to say any properties included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Enquiries are likely to be incomplete.

Apart from showing that the land parcel in Ashby is connected to the mains water supply and mains drainage what other replies does a a CON29DW show? A water authority search illustrates to a potential buyer that the land parcel they are acquiring does not need a “build over consent” because the owner has constructed an addition to the house near a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is always likely to be a mortgage offer to apply for and it should be noted that a solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. She must have sight of your final written mortgage offer in order that they may (i) be able to check that you are getting the amount you need and verify that you can comply with any conditions of the mortgage offer imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some times now although this was brought in at different times across the country. For the time period in Ashby you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ashby

Are you able to manage a mortgage with Cynergy Bank in Ashby? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Ashby? Is this a problem? No because like all modern practices we depend on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashby).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Stamp Office is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within 3 years.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by freeholder and managing agents will vary for providing assignment packs often in a form called LPE1. The charge for this varies from company to company often it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 maisonettes.
