Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such buyers think they know what a Enquiries of the local authority search will reveal and may know about the Ashdon or surrounding neighbourhood however most conveyancing solicitors will still recommend one. One of the main reasons is that the Official Local Authority search is the only place to reveal debts to the council and this is more commonly the case with probate properties.

When we order a Environmental check on the property mentioned on the conveyancing quote for the property in Ashdon what will it reveal? The search provides data of present and past pollution risks together with a statement from an environmental consultant confirming whether or not the ground could be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

Apart from showing that the home in Ashdon is connected to the mains water supply and mains drainage what other replies does a a CON29DW include? A Drainage & Water Enquiry verifies to a prospective purchaser that the house they are buying does not need a “build over consent” because the owner has constructed an addition to the house within three metres of a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We had a lengthy process with our lender in relation to a re-mortgage which was a bit tedious but Mouazzam Yamin helped us to get to the end of what could have been a painful process. Grateful for the help and eventually completing which was a great moment for me! Excellent and proffesional conveyancing service received for the purchase of my property. Mouzzam Yamin and Mark Sadler were both very helpful and informative with replies to my queries. Easy to deal with and hassle free.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

Remember there are invariably one or more related sales involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your matter and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time period in Ashdon you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ashdon

Are you able to oversee a mortgage with Santander in Ashdon? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Ashdon? Is this a concern? No because like all modern firms of lawyers we depend on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashdon).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Revenue is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within three years.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200 but is can be more in rare cases. Second, the lease may contains a provision for the selling to pay a payment to the management company based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
