Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local authority covering Ashford Carbonell. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

Why do we need environmental enquiries in Ashford Carbonell? Statutory legislation have resulted in a remediation scheme for contaminated land parcels. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Ashford Carbonell you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

What is a water authority search ? A a CON29 DW search confirms to a potential owner that the property they are interested in is connected to the mains water supply and mains drainage. This is particularly significant in parts of Ashford Carbonell which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to clear. You can speed the process if it is your first purchase. You may be able to exchange and complete simultaneously. However your option depend on what  others in the chain will allow.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a purchaser makes is not checking the plan properly. It is a best to visit the property to check that what is shown on the plan agrees with what you think you’re buying on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to find out that the legal title to the home doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Ashford Carbonell you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ashford Carbonell

Are you able to deal with a mortgage with Virgin Money in Ashford Carbonell? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Ashford Carbonell.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Taxman is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained Letters of Administration for my fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.
