Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The timescale for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed processed manually by the Local Authority. Also the search time can be affected by seasonal demand levels and local council staffing levels.

I heard that the official local Enquiries in Ashmansworth will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying polluted properties and recording these areas on registers – this is a process which will take a unknown period of time to deliver upon. Needless to say any land parcels entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

Why is a a CON29 DW search useful if you want to extent or alter the land parcel in Ashmansworth? One of the important replies shows information of any public sewer nearby the home you are acquiring. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the extension more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your house to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs necessary to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ashmansworth some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Ashmansworth

Are you able to deal with a mortgage with Santander in Ashmansworth? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Ashmansworth? Is this a problem? No because like all modern firms we rely on technology to assist us in our practice to ensure that matters are dealt with quickly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashmansworth).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Stamp Office is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 36 months.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We are executors of my mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
