Searches on my Conveyancing Quote

How long do Local Authority search searches take? The wait time for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches through our search provider’s website some searches are still processed processed manually by the council. Also the search time can be affected by seasonal demand levels and local council staffing levels.

I am advised that the official local Search in Ashton will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that councils are now in the process of identifying contaminated properties and recording these properties on registers – this is a process which will take a unknown period of time to complete. Needless to say any properties included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Enquiries are likely to be incomplete.

Why is a a CON29 DW search fundamental if you want to extent or alter the land in Ashton? One of the main replies shows a plan of of any public sewer close to the land parcel you are purchasing. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the foundations more costly.

General Conveyancing Tips

There is often a mortgage to arrange and it should be noted that a lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. We should have sight of your official written mortgage offer in order that they may (i) ensure that you are getting the amount you need and ensure that you can comply with any lender’s conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time scale in Ashton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ashton

Are you on the panel of Godiva Mortgages Ltd? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Ashton? Is this a issue? No because like all modern practices we depend on technology to assist us in our office to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashton).

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain actions to facilitate release of those ISAs including any bonus. If you complete the quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional expenses can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by landlords and management companies will vary for providing information often in a pro forma response called LPE1. The charge for this varies from company to company on average it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
