Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental checks in Ashwater? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Is there a need environmental searches in Ashwater? Statutory legislation have resulted in a remediation scheme for polluted land parcels. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an lease in Ashwater you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Why is a drainage search key if you want to extent or alter the house in Ashwater? One of the main details shows a map of any public sewer on the site you are acquiring. This is significant because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the extension more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your property to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Ashwater you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

No because like all modern lawyers we rely on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashwater).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain actions to make sure release of those savings including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300k. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Ashwater? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We have obtained probate for our parents estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
