Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental checks in Ashworth? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do we need environmental enquiries in Ashworth? Statutory laws have resulted in a clear-up scheme for contaminated land. The basic position is that the polluter should clear-up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the current owner (who could be you). Even if you are purchasing an leasehold in Ashworth you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

What is a drainage search ? A water authority search confirms to a future interested party that the home they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Ashworth which are country as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

This firm is probably the best I’ve ever dealt with regarding house moves. Mouzzam was very helpful in dealing with queries and very proactive with dealing with requests. It’s good to have a service that contacts you straight away rather than you having to constantly chase for information and answers. Our house move was a very difficult situation brought on by the buyers but he dealt with it in an exemplary and professional manner.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

Remember there are commonly one or more related purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest purchase.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a best to go to the land parcel to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the property is theirs, only to discover that the legal title to the property doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Ashworth you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ashworth

Are you able to deal with a mortgage with Barclays Bank UK plc in Ashworth? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in Ashworth? Is this a concern? No because like all modern firms we rely on technology to assist us in our firm to ensure that matters are dealt with expeditiously. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ashworth).

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main home. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within three years.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We are executors of our fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
