Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental checks in Askham? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do we need environmental investigations in Askham? Statutory legislation have resulted in a clean-up scheme for contaminated ground. The basic position is that the polluter should remediate however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Askham you may find that you are liable for the cost of any clear-up through the service charge provisions of the lease.

What is a water authority search ? A drainage search confirms to a potential buyer that the site they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Askham which are not built up as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Excellent experience, purchased my first property with ease. A big thanks to Mouzzam Yamin for staying on top of things and giving updates. Personally thought it would be a mission but KER made it possible.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is invariably a mortgage to apply for and it should be noted that a solicitor cannot rely on a quick email by mortgage broker or anyone else. We should have sight of your official written mortgage offer in order that he may (i) be sure that you are getting the money you need and verify that you can comply with any offer conditions imposed in the mortgage offer.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a customer makes is not checking the plan properly. It is a best to go to the home to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the house doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time period in Askham you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Askham

Are you on the panel of Precise Mortgages? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Askham.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by freeholder and management companies will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from company to company usually it is approximately £2500 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple flats.
