Searches on my Conveyancing Quote

What is a Local Authority Search and why is it needed in Askrigg? Whilst this is to a conveyancers and lenders an critical component of the home buying process to consumers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In some cases the information revealed can be used to change your the price or and may even make you withdraw from the purchase.

I heard that the official local Enquiries in Askrigg will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of finding contaminated areas and recording these sites on registers – this is a process which will take a many years to deliver upon. Needless to say any properties listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local Searches are likely to be incomplete.

Why is a drainage search significant if you want to extent or alter the home in Askrigg? One of the key replies shows a map of any public sewer close to the land parcel you are interested in. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the works cost more.

General Conveyancing Tips

Remember there are frequently a few linked transactions involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a home buyer makes is not checking the plan properly. It is a good idea to go to the property to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to later discover that the legal title to the land doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays necessary to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Askrigg some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a buy to let in Askrigg? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional costs can we anticipate? We cannot give you all the disbursements up front in our estimate. The costs charged by freeholder and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation often it is approximately £2500 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into two maisonettes.
