Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing home and do not necessarily have to conduct a search. Many such purchasers think they know what a Enquiries of the local authority search will reveal and may know about the Askrigg or surrounding neighbourhood however most conveyancers will still recommend one. One of the main reasons is that the local search LLC1 is the only place to reveal liabilities to the Local Authority and this is more commonly the case with probate properties.

I am advised that the local authority Enquiries in Askrigg will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of finding contaminated ground and recording these sites on registers – this is a process which will take a number of years to deliver upon. Needless to say any land listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Apart from showing that the property in Askrigg is connected to the mains water supply and mains drainage what other information does a Drainage & Water Enquiry show? A a CON29DW illustrates to a potential buyer that the home they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house within three metres of a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all expenses needed to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Askrigg some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Askrigg

Are you on the panel of West Bromwich Building Society? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Askrigg? Is this a concern? No because like all modern firms we rely on technology to assist us in our firm to ensure that matters are dealt with promptly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Askrigg).

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain steps to make sure release of those ISAs including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 3 years.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are administrators of my family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
