Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing home and do not necessarily have to conduct a search. Many such home buyers think they know what a Enquiries of the local authority search will reveal and may know about the Aslacton or surrounding area however most conveyancing lawyers will still advise one. One of the main reasons is that the local search LLC1 is the only place to reveal debts to the borough and this is more commonly the case with properties where the owner has gone into a home.

Why do we need environmental investigations in Aslacton? Statutory rules have resulted in a clean-up scheme for polluted sites. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an flat in Aslacton you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Why is a a CON29DW decisive if you want to extent or alter the site in Aslacton? One of the essential results shows a map of any public sewer on the land parcel you are purchasing. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the foundations cost more.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all expenses incurred to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aslacton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Aslacton

Are you on the panel of Paragon? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Aslacton? Is this a issue? No because like all modern solicitors we count on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Aslacton).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Aslacton? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the administrators of our family estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
