Searches on my Conveyancing Quote

How long do Local Authority search searches take? The ETA for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches via a website some searches are still processed administered manually by the council. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

I believe that the local authority Enquiries in Aspenden will show if the land is contaminated. Is that right? No. Whilst it is correct that councils are now in the process of identifying polluted land parcels and recording these land on registers – this is a process which will take a a long time to finish. Needless to say any properties included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Why is a water authority search important if you want to extent or alter the property in Aspenden? One of the indispensable replies shows a map of any public sewer on the house you are acquiring. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the addition cost more.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time in Aspenden you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you able to handle a mortgage with Cynergy Bank in Aspenden? Yes we are on the mortgage Panel for this lender.

Are you able to handle Help to Buy ISAs in Aspenden? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain actions to facilitate release of those ISAs including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 36 months.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional payments can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a form called LPE1. The charge for this varies from organisation to organisation often it is approximately £300 but is can be higher in unusual cases. Second, the lease may contains a agreement for the outgoing to pay a fee to the freeholder based on a percentage of the sale price which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
