Searches on my Conveyancing Quote

What is included in a local authority search covering Aspley? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

When we order a Environmental check on the property mentioned on the conveyancing quote for the property in Aspley what will it reveal? The search provides information of present and past pollution risks together with a report from an environmental expert confirming whether or not the ground would be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

Apart from showing that the home in Aspley is connected to the mains water supply and mains drainage what other data does a a CON29 DW search contain? A water authority search verifies to a prospective buyer that the property they are buying does not need a “build over consent” because the seller has constructed an addition to the house within three metres of a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your transaction and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time in Aspley you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aspley

Are you on the panel of Nationwide Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Aspley.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are administrators of our parents estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
