Searches on my Conveyancing Quote

What is a Local Authority Search and why is it needed in Assington? Whilst this is to a solicitors and lenders an important piece of the home buying process to consumers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In extreme cases the information revealed can be used to alter your the price or and may even make you pull out of from the transaction.

Do you recommend that both of us obtain an Environmental search on the property that we are buying in Assington? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of suppliers including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the site, based upon the information revealed by the search, might be designated contaminated land by the Local Authority.

Why is a a CON29 DW search essential if you want to extent or alter the site in Assington? One of the important details shows the location of any public sewer on the land parcel you are acquiring. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the works cost more.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on costs disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Assington you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Assington

Are you able to deal with a mortgage with Tipton & Coseley Building Society in Assington? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Assington? Is this a concern? No because like all modern law firms we rely on technology to assist us in our practice to ensure that matters are dealt with speedily. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Assington).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from company to company usually it is around £2500 but is can be more in rare cases. Second, the lease usually contains a agreement for the assignor to pay a payment to the freeholder based on a % of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
