What is included in a local authority search covering Assington? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am told that the local authority Enquiries in Assington will show if the land is contaminated. Is that right? No. Whilst it is correct that Local Authorities are now in the process of locating contaminated sites and recording these land parcels on registers – this is a process which will take a a long time to accomplish. There is commonly a mortgage loan to organise and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and purchase and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? Make sure that any quotes you download contain all costs, disbursements and VAT. If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all bills required to uphold the fabric of the building. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.
