Searches on my Conveyancing Quote

What is included in a local authority search covering Astley Abbots? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is maintained at public expense, proposals for new roads, railway schemes or planning history relating to the title. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I think that the local authority Search in Astley Abbots will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that councils are now in the process of locating polluted land parcels and recording these properties on registers – this is a process which will take a decades to end. Needless to say any areas listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a a CON29DW ? A Drainage & Water Enquiry confirms to a potential buyer that the home they are acquiring is connected to the mains water supply and mains drainage. This is particularly important in parts of Astley Abbots which are not built up as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

No delays and completed very quickly. Would absolutely use again and would recommend to others. I came across this firm while researching conveyancing issues online, and they had a very informative blog. I have completed the purchase within 3 months without any issues. Mouzzam and Tricia at KER were great. Always quick to reply to my emails and processed paperwork very quickly in relation to my house purchase. Their service was very professional and I would use again. Fantastic service, professional and competent.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your house to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Astley Abbots you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Astley Abbots

Are you able to deal with a mortgage with Melton Mowbray Building Society in Astley Abbots? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Astley Abbots? Is this a issue? No because like all modern lawyers we count on technology to assist us in our firm to ensure that matters are dealt with quickly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Astley Abbots).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by landlords and management companies will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is around £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple flats.
