Searches on my Conveyancing Quote

What is included in a local authority search covering Aston Clinton? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am advised that the Land Charges Searches in Aston Clinton will show if the land is contaminated. Is that accurate? No. Whilst it is correct that councils are now in the process of identifying contaminated areas and recording these properties on registers – this is a process which will take a a long time to finish. Needless to say any properties named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Why is a a CON29DW salient if you want to extent or alter the site in Aston Clinton? One of the basic results shows the location of any public sewer adjacent the site you are interested in. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the build cost more.

Thank you Mouzzam and Tricia were very helpful and professional throughout the purchase process. Whenever they got a new piece of information or documentation they quickly turned it around and kept us up to date with the implications. They were also very approachable, replying to our questions as we went through the process. Would recommend.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is always likely to be a mortgage loan to apply for and it should be noted that a conveyancer cannot rely on a oral confirmation by mortgage broker or anyone else. They must generally have sight of your formal written mortgage offer in order that she may (i) verify that you are getting the loan you need and be able to check that you can comply with any conditions of the mortgage offer imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your transaction and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all expenses incurred to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aston Clinton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Aston Clinton

Are you able to conduct a mortgage with Chorley Building Society in Aston Clinton? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Aston Clinton.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 3 years.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I have obtained probate for our parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
