Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental investigations in Aswardby? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I think that the Con29 Enquiries in Aswardby will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of locating polluted land parcels and recording these areas on registers – this is a process which will take a number of years to deliver upon. Needless to say any property named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Apart from showing that the house in Aswardby is connected to the mains water supply and mains drainage what other information does a Drainage & Water Enquiry show? A water authority search confirms to a potential owner that the house they are interested in does not need a “build over consent” because the vendor has constructed an alteration adjacent a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your house to take on average 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all expenses necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aswardby some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

Are you able to handle a mortgage with Cambridge Building Society in Aswardby? Yes we are on the mortgage Panel for this lender.

Are you able to manage Help to Buy ISAs in Aswardby? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain checks to make sure release of those ISAs including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from company to company usually it is approximately £200 but is can be more in unusual cases. Second, the lease often contains a mechanism for the assignor to pay a charge to the landlord based on a percentage of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
