Searches on my Conveyancing Quote

What is included in a local authority search covering Atcham? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

When we obtain an Environmental search on the property mentioned on the conveyancing quote for the property in Atcham what will it reveal? The search provides results of present and past pollution risks together with a statement from an environmental expert confirming whether or not the property might be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon risks.

Apart from showing that the property in Atcham is connected to the mains water supply and mains drainage what other results does a Drainage & Water Enquiry include? A drainage search verifies to a new purchaser that the land parcel they are acquiring does not need a “build over consent” because the seller has constructed an alteration within three metres of a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

Completed on our first home April 2016 and these guys were brilliant. Freddie Rylah guided us through the process step by step and was always available to answer any questions and help us out. As first time buyers we were reassured at every turn and the whole thing was quick and successful! Would highly recommend.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is often a mortgage loan to apply for and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The Firm must generally have sight of your final written offer of mortgage in order that they may (i) be able to check that you are getting the money you need and ensure that you can comply with any offer conditions imposed in the mortgage loan.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a purchaser makes is not checking the plan properly. It is a good idea to go to the property to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often buyers mistakenly think that a piece of land at the side or rear of the land is theirs, only to later discover that the legal title to the site doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time period in Atcham you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Atcham

Are you on the panel of Nationwide Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Atcham? Is this a concern? No because like all modern solicitors we rely on technology to assist us in our office to ensure that matters are dealt with promptly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Atcham).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main residence within 36 months.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple maisonettes.
