Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Athelney. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

Do you recommend that both of us order a Environmental enquiry on the property that we are buying in Athelney? Yes we including this in our quote. We would always recommend an environmental check on the area you intend to purchase which is available from a number of search companies including Landmark. The environmental search results provide details of present and past environmental risks together with a certificate from an environmental consultant confirming whether or not the property, based upon the information revealed by the search, would be officially names as contaminated land by the London Borough/council.

What is a a CON29 DW search ? A water authority search confirms to a potential purchaser that the house they are interested in is connected to the mains water supply and mains drainage. This is particularly significant in parts of Athelney which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses necessary to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Athelney some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Athelney

Are you on the panel of Bluestone Mortgages? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Athelney? Is this a problem? No because like all modern firms we depend on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Athelney).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Athelney? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company usually it is approximately £200 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two maisonettes.

About Athelney.

Athelney is a village located between the villages of Burrowbridge and East Lyng in the Sedgemoor district of Somerset, England. The name is believed to be derived from the Old English æþeling meaning “prince” + –ney meaning “isle”. The village is best known for once being the fortress hiding place of King Alfred the Great, from where he went on to defeat the Great Heathen Army at the Battle of Edington in May 878.
