What is a Local Authority Search and why is it needed in Atherington? Whilst this is to a solicitors and lenders an important part of the home buying process to consumers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In some cases the results can be used to renegotiate your the purchase price or and may even make you pull out of from the matter.

I think that the local authority Search in Atherington will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of identifying contaminated ground and recording these areas on registers – this is a process which will take a number of years to deliver upon. Needless to say any ground included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

What is a Drainage & Water Enquiry ? A a CON29DW confirms to a new buyer that the property they are acquiring is connected to the mains water supply and mains drainage. This is particularly important in parts of Atherington which are countryside as there may be a a private drainage system.

Helpful and understanding through a very stressful period in our lives Mouzzam was extremely helpful with our whole process. Lots of experience and very helpful throughout the property purchase and sales cycle. We have used K.E.R. for over two decades and very happy with their service.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is often a mortgage offer to apply for and it should be noted that a solicitor cannot rely on a quick email by mortgage broker or anyone else. She must generally have sight of your formal written offer of mortgage in order that she may (i) be sure that you are getting the loan you need and ensure that you can comply with any lender’s conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills required to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Atherington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Atherington

Are you able to handle a mortgage with Dudley Building Society in Atherington? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Atherington? Is this a issue? No because like all modern firms we depend on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Atherington).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Atherington? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We are administrators of my mother estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
