Searches on my Conveyancing Quote

What is included in a local authority search covering Atlow? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I am advised that the Con29 Enquiries in Atlow will show if the land is contaminated. Is that right? Not really. Whilst it is correct that Local Authorities are now in the process of identifying polluted sites and recording these sites on registers – this is a process which will take a an uncertain amount of time to deliver upon. Needless to say any land parcels included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

Why is a drainage search important if you want to extent or alter the land parcel in Atlow? One of the indispensable replies shows a plan of of any public sewer close to the site you are purchasing. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the build cost more.

General Conveyancing Tips

There is always likely to be mortgage finance to obtain and it should be noted that a conveyancing lawyer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancer must have sight of your official written mortgage offer in order that she may (i) ensure that you are getting the loan you need and be sure that you can comply with any conditions of the mortgage offer imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time period in Atlow you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Atlow

Are you on the panel of Buckinghamshire Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Atlow? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Stamp Office is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within 36 months.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from company to company on average it is around £300 but is can be more in extreme cases. Second, the lease often contains a mechanism for the assigning to pay a fee to the landlord based on a % of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
